Corey Blackmore, 23, an inmate at Silverwater Jail, pleaded guilty to assault occasioning actual bodily harm when he appeared by audio-visual link in Goulburn Local Court on Wednesday.
Police said on April 27 at 9.05am Blackmore was an inmate at the Goulburn jail and was in Yard 12 when he approached another man and got into an argument. Blackmore was then seen to walk away from the man, but approached him again, throwing punches. Blackmore picked up the other man and dropped him on his head on the concrete floor of the yard.
Correctional officers arrived and separated all parties. The victim was airlifted to Prince of Wales Hospital, Sydney, for treatment of a closed head injury, but did not suffer any long-term injury as a result of the assault.
On July 11 at Silverwater, Blackmore admitted to the assault and stated he only did what he did because the victim had demanded money of him on behalf of another inmate and he felt threatened.
Blackmore’s solicitor said his client felt that if he did not fight back he would end up injured.
“The victim suffered no long-term injuries and he was cooperative with police,” the solicitor said.
She said he suffered from an anxiety disorder and mental health problems.
Police prosecutor Fiona Ryan said assaults in jails need to be deterred.
Magistrate Carolyn Huntsman said a message needed to be sent to the community that assaults in jails would not be tolerated.
“It is a serious offence,” she said.
“What you did caused concern for a head injury because he hit his head on the ground.”
Blackmore’s earliest release date had been December 26, but Ms Huntsman sentenced him to a jail term of 12 months with a non-parole period of nine months, starting from September 24. His earliest release date is now June 24, 2017.
