Councillors will consider a confidential report about the Common Street waste facility at their meeting on Tuesday.
The yard, at 2-12 Common Street, has come under EPA notice in recent time for its volumes and reports of vermin.
Council general manager Warwick Bennett said the report on Tuesday was an “update on council’s legal position” regarding the yard.
The report is recommended for closed session due to confidential legal advice.
Mr Bennett declined further comment on whether the council was taking legal action against the operator, Southern State waste Recycling.
In August, Mr Bennett said the EPA had no ability within its structure to order the waste’s removal, only monitor compliance.
“All the complaints we receive are forwarded to the EPA,” he said at the time.
“We fully understand and share the frustrations of the neighbours, as this land owner continues to operate the facility in a manner that we believe does not align with being a good neighbour and community citizen. However we won’t give up, and we will continue to maintain pressure on the owners of the site through the EPA.”
But Southern State Recycling operating manager Chris Eveston rejected claims that the pile was generating vermin and said the company abided by all regulations and licence conditions.
In August the EPA was investigating a neighbour’s complaint about vermin and litter at the facility. A spokeswoman said the Authority was also liaising with Goulburn Mulwaree Council about the site.
