A new motor vehicle accident compensation system was introduced by the NSW State Government on December 1, 2017.
The Motor Accident Injuries Act 2017 covers any person who is injured or loses their life as a result of a motor accident.
If you find yourself in a position where you need to make a claim, it’s important to enlist the help of someone who is an expert in the area of compensation law.
RMB Galland Elder Lawyers have a team who work solely in this area of law and know all of your entitlements, the processes you need to follow and are on top of all the changes that come into effect with new legislation. Les Heinrich a compensation division leader at RMB Galland Elder Lawyers said the new Act is a major overhaul of our current system.
“The new system will in many ways mirror the devastating changes which the State Government has introduced to workers compensation laws since June 2012,” Mr Heinrich said.
“In a nutshell, the new laws will severely reduce the compensation payable to people injured in vehicle accidents in NSW. Caps will be introduced in relation to how much a person can claim for wage loss and how long those payments will be payable for. The same will apply to medical expenses. Only those with extremely severe injuries will be compensated for their pain, suffering and any permanent impairment and disablement that they sustain.”

RMB Galland Elder Lawyers can help claimants from the time of the accident, right through until the claim is resolved by way of a payment of compensation to them.
“It’s important to obtain legal advice in order to protect your potential rights as the Act which governs these types of claims involves some complexity,” Mr Heinrich said. “We also take into account personal circumstances and ensure injured persons have the treatment they need and if they are unable to work, we can assist them by obtaining interim payments from the insurer so that they can meet their financial responsibilities.”
RMB Galland Elder Lawyers understand that many people often suffer financial hardship as a result of being injured. To assist you, they conduct an assessment of your claim on a ‘no win - no fee’ basis. Mr Heinrich said, “If you have a valid claim to pursue, it is likely that we will offer to act for you on the basis that you will not have to pay for our highly specialised services unless your claim is successful.”
