At Goulburn District Court on February 4 Barrister Brendan Green presented an application to produce fresh evidence to appeal his client's conviction.
Mr Green said Judge Mark Williams wasn't bound by decisions made by the previous magistrate on the case.
"The level of force used in [Murray's] mind was necessary in that situation," he said.
Judge Williams said the evidence was fresh and it was in the interest of justice to hold an appeal hearing.
Murray will be before Goulburn District Court again on February 15.
