Judge Julia Baly adjourned sentencing and denied Kelly bail.
Defence lawyer Kathryn Hall told the court she had been contacted by the offender at 4:55pm two days ago to transfer legal representation.
"The circumstances are extremely unfortunate and very unusual," Ms Hall said.
The judge said the lawyer had been "placed in a very difficult position" and she opted "somewhat reluctantly" to adjourn sentencing.
In response to a suggestion the case be moved to another court, Judge Baly argued she did not want to move the matter out of Goulburn.
"There are people in the local community who have a right to know what's happening in this matter," she said.
Crown prosecutor Mr Todd argued against granting Kelly bail. He argued an ACT Community Corrections Pre-sentencing Report had assessed Kelly to have an "above average risk of re-offending in relation to sexual offences."
Ms Hall told the court Kelly had obeyed "stringent bail conditions" since the 2019 offence and had "never failed to comply".
Judge Baly said Kelly posed an "unacceptable risk to the community".
"[Kelly] denies and continues to deny the offence he was found guilty of," she said.
"In relation to the offence there is no viable sentence other than a period of full-time custody."
Kelly will reappear at Goulburn District Court on August 13. The judge ordered a Sentencing Assessment Report to be completed by NSW Corrective Services.
